Insurance Arbitration Commission, which is established by the new Code of Insurance No.5684, aims at the resolution of disputes between the policy holders or beneficiaries of insurance contracts on the one hand and the insurers assuming the risk on the other, in a simple, prompt and fair manner by expert arbitrators. The Commission provides the insurance holders with a new and practical alternative with respect to the courts, in order to enable them to get quicker results by following a less costly procedure. The disputes that are referred to the Commission will be settled by independent arbitrators within the time limits prescribed by law, unless parties make an agreement to extend such periods. Insurance arbitration system is based on voluntary participation of the insurance institutions. Therefore, before applying to the Commission, please check carefully that the insurer with whom you are having a dispute is a member of the arbitration system and the risk which is the subject-matter of the dispute occurred after the date of the insurer?s membership. If these conditions are met, you can apply to the Commission even if there is no written arbitration agreement between you and the insurer concerned. In the process of setting the structure of insurance arbitration system, special care has been devoted to making the procedures as simple and understandable as possible for applicants, thus avoiding any unduly bureaucratic or confusing requirements. After the conditions for applying to the Commission are fulfilled, only thing you need to do is to fill in the application form that you can obtain from our website or request from our office, attach the relevant documents and send it to the Commission with the copy of bank receipt showing that you have deposited the application fee.
